Terms of Service

These Terms of Service (“Terms”) govern your use of The Perks (the “Service”), operated by Do Stuff Media (“we”, “us”). By claiming a mailout offer, unlocking a community board, or creating a merchant account, you agree to these Terms. If you do not agree, please do not use the Service.
The Service
The Perks connects local businesses with people in their community through digital offers. Offers reach you two ways: as mailout offers, which are public and claimable by anyone with the code or link, and through a private community board you unlock with a card. Residents can claim offers and redeem vouchers; merchants can create offers and target them to communities they have been granted access to. Offers are provided by the businesses that create them, not by The Perks.
Accounts and access
- Mailout offers (public). Some offers are distributed by mailout — a printed code or link that opens the offer. You can claim these with just your name and email; no card, membership, or account is required. A public claim is generally limited to one per person per offer.
- Community boards (private).Access to a community board is unlocked with the bespoke code printed on your card and is locked to your device. Access is personal to you and is not transferable. It may expire (a digital “lease”) and can be renewed by re-entering your card’s code. Offers on a community board may refresh on a schedule (for example, monthly), so a board offer can become claimable again after it resets.
- Merchants. You are responsible for the accuracy of your business and offer details, and for keeping your account credentials secure. You are responsible for honouring the offers you publish.
- You must provide accurate information and keep it up to date.
The two overlap: someone who received a mailout may also be invited to a community board, and a community-board member can still claim public mailout offers.
Offers and vouchers
- Offers are subject to availability and may have limits, expiry dates, and other conditions set by the merchant.
- Vouchers have no cash value, cannot be exchanged for cash, and are generally limited to one per person per offer, unless stated otherwise; community-board offers may reset on a schedule and become claimable again.
- The merchant is solely responsible for fulfilling any offer or voucher. Any dispute about an offer is between you and the merchant.
- We may remove or close an offer at any time; a closed offer can no longer be claimed.
Acceptable use
You agree not to:
- Attempt to claim offers fraudulently, circumvent claim limits, or access boards you are not entitled to.
- Interfere with, probe, or disrupt the Service or its security.
- Use the Service to violate any law or the rights of others.
Intellectual property
The Perks name, branding, and the Service (excluding merchant-supplied content) are owned by us or our licensors. Merchants grant us permission to display the content and branding they upload for the purpose of running their offers.
Disclaimers
The Service is provided “as is” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that any offer will be available or honoured.
Limitation of liability
To the fullest extent permitted by law, The Perks will not be liable for any indirect, incidental, or consequential damages, or for any loss arising from an offer or a merchant’s conduct. Nothing in these Terms limits liability that cannot be limited under applicable law.
Termination
We may suspend or terminate access to the Service at any time if you breach these Terms or to protect the Service and its users. You may stop using the Service at any time.
Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
